Structure of Our Lands

Village – A village only has a Town Elder. The Town Elder makes all decisions. Villages do not have enough Guilds to support a High Council.

Town – A town possesses a High Council. The High Council is made up of three or more Guilds and a Town Elder. Houses also have seats upon the High Council, however only vote if their Guild(s) are not present.

City – A city possesses a High Council. A town becomes a city when there are three or more Houses. In the event that a town becomes a City, the Guild Seats on the High Council are replaced by the Houses and the Town Elder is replaced by a City Mayor. A Thane also has a seat upon the High Council, however only votes if there is a House that is not present.

Thanedom – An area becomes a Thanedom when a Thane is elected.

Barony – A larger area encompassing two or more Thanedoms when a Baron is elected.

Duchy – An even larger area encompassing two or more Baronies when a Duke has been elected.

Kingdom – All of the land encompassing two or more Duchies ruled by a King when one has been crowned by two or more Dukes.











Elected Officials

Magistrate – Elected by majority vote of the High Council. The Magistrate is responsible for proposing laws, enforcing laws, making judgments, and passing sentence. The Magistrate must be in no Guild or House. The Magistrate may request additional resources from the High Council such as a jail, stocks, shackles, or potions if circumstances deem it necessary. The High Council can approve these resources and the means in which they should be attained through a majority vote. The Magistrate is a servant of the town and may not pledge their allegiance to any man or woman. Doing so may result in removal from position.


Constable – Elected by majority vote of the High Council. The Constable is responsible for enforcing the law, bringing criminals to justice, and those accused of crimes to trial. The Constable is also in charge of assigning duties to members of the Town Guard. The Constable should make certain that at least two guard members remain behind to maintain order in the Constable’s absence from town. The Constable is a servant of the town and may not pledge their allegiance to any man or woman. Doing so may result in removal from position. The Constable can be granted the power of Martial Law by a unanimous vote of the High Council in times of great peril. These powers may be revoked by a majority vote of the High Council. Martial Law is the granting of all power to the Constable. The High Council will make no more decisions until Martial Law is given up by the Constable or revoked by a majority vote of the Council. During Martial Law, all rights of the citizens of Haven are removed and the Constable is given complete authority to do as (s)he sees fit as an absolute ruler. Martial Law would be imposed in a time of great crisis such as war or if civil authority were to break down. The Constable has the power of Search and Seizure as means of investigation. The Constable has the power of Arrest. The Constable also has the power of conscription and confiscation. If the Constable is found to be abusing these powers, the High Council will take action accordingly. The Constable may also ask the High Council for additional resources as needed, such as potions, weapons, armor, or spells. The High Council can approve these resources and the means in which they should be attained through a majority vote.

High Council Structure

If the town has less than 3 Guilds – There is no High Council.

If the town has more than 2 Guilds but less than 3 Houses – The High Council is made up of all of the Guilds who wish to have a seat on the High Council. At least 3 Guild Heads must be willing to participate. House Heads will also have a seat on the High council, but will receive no vote unless a member Guild Head is absent. In this instance the House Head may vote for any Guild Heads in their House who are absent. The Town Elder will receive a vote only if there is a tie, so that (s)he may break that tie. The Magistrate and Constable may be present at any meetings of the High Council and should help to advise the Council on various matters.

Guild participation requirements: The participation requirements of a Guild so that they may have a seat on the High Council can change from month to month by vote of the High Council. Guilds must offer at least one Guild Member to participate in the Town Guard each month. The Guilds are still responsible for the care of their member who has joined the Town Guard. Guild Heads are required to donate a certain amount of Food, Clothing, and Shelter as decided by the Council. These donations may not be any less than what is required to support all Voluntary members of the Town Guard, the Town Elder, the Magistrate, and the Constable. It is recommended that a High Council Member is elected to keep track of these foodstuffs, clothing, and offerings of shelter so that if there is excess, it can be saved for future use.

House participation requirements: The participation requirements of a House so that they may have a seat on the High Council can change from month to month by vote of the High Council. Houses must offer at least one House Member to participate in the Town Guard each month. The Houses are still responsible for the care of their member who has joined the Town Guard. House Heads are required to donate a certain amount of Food, Clothing, and Shelter as decided by the Council. Town Guard

The Town Guard is in charge of setting up patrols, defending the town in event of attack, apprehending criminals, and apprehending suspects for trial.

Voluntary Town Guard Participation: The participation requirements of a Citizen so that they may be part of the Town Guard are threefold. First, the Citizen may not be a member of a House. Second, the Citizen may not be a member of a Guild. Third, the Citizen must be in ample condition to perform Guard Duties. Voluntary Town Guard members will be fed, clothed, and sheltered by the High Council.

Involuntary Town Guard Participation: The Town Guard also consists of Guild members by requirement of Guild Seat Participation and may consist of Citizens who have been sentenced to Town Guard duties. The Town Guard must follow the orders of the Constable.

PUNISHMENT

PUNISHMENT

The following document describes the laws in which Citizens of the Haven shall live by. Those who are not Citizens are still subject to our law, however they are not necessarily protected by it. This document also defines guidelines by which a first offense should be punished. These suggestions may not always be adhered to as some circumstances may warrant a harsher or lighter sentence, this is up to the Magistrate to decide. The Magistrate is considered the Voice of the High Council when it comes to matters of Law. If, at any time, a member of the High Council disagrees with a ruling made by the Magistrate, they may postpone the sentence of the accused to hold an emergency meeting of the High Council in order to attempt to attain a majority vote to overturn the Magistrate’s decision. The following twenty punishments are listed in order of lightest punishment to harshest punishment.


1) Public Apology – This punishment requires that the convicted make a prepared apology publicly. This may range from a simple apology to a full speech, depending on the sentence.

2) Minor Public Service – This punishment requires that the convicted perform a small amount of Public Service, such as a day of Guard Duty or scrubbing the floor of the Inn.

3) Minor Fine – This punishment requires that the convicted pay a fee, such as a bit of steel or some cloth.

4) Jail Time or The Stocks – This punishment requires a short period of captivity either in private or in the public stocks.

5) Major Public Service – This punishment requires that the convicted perform a major public service, such as building a new building, being placed in the Town Guard for a moderate period of time, or scrubbing the floors of the Inn every weekend for a year.

6) Major Fine – This punishment requires that the convicted pay a fee, such as a cache of steel, a chest of cloth, or a store of food.

7) Corporal Punishment – This punishment requires that the convicted be beaten.

8) Temporary Oath – This punishment requires that the convicted swear an oath for a set amount of time. This is an Oath of Fealty, however is for a shorter prescription of time than a normal Oath of Fealty.

9) Branding – This punishment requires that the convicted be Branded for their crime.

10) Starvation – This punishment requires that the convicted be placed on the brink of starvation for a set amount of time.

11) Peasantry – This punishment requires that the convicted throw down weapons and farm the fields.

12) Mutilation – This punishment requires that the convicted be mutilated, such as losing their hand, their hair, or an eye.

13) Long Term Imprisonment – This punishment requires that the convicted be locked up for a great amount of time.

14) Quest of Redemption – This punishment requires that the convicted set out on a quest determined by the court in order to redeem themselves.

15) Fealty – This punishment requires the convicted swear fealty to an individual or group of people.

16) Exile – This punishment requires the convicted leave the Haven for a set amount of time, perhaps never to return.

17) Death by Unconscious Beheading – This punishment requires that the convicted be placed into an unconscious state and that they are beheaded.

18) Death by Other Means – This punishment requires that the convicted be killed by means other than unconscious beheading, such as Death by Hanging or Death by Powerful Magics.

19) Death in a Painful Manner – This punishment requires that the convicted be killed by painful means such as Stoning or Burning at the Stake.

20) Death and Destruction – This punishment requires that the convicted be utterly destroyed. An example of this would be the convicted’s death by an empath’s magic, followed by dismemberment, followed by the removal of their organs, then the parts burned by magical flame, the ashes separated into multiple jars, and finally, the ashes buried across different portions of the countryside.

i. Thou Shall Not Burgle. Burglary is the act of breaking into a place of residence owned by another citizen of the Haven and taking their possession(s).

xv. Thou Shall Not Disturb the Peace. Disturbing the Peace is an act of grave annoyance to one’s neighbors. Being in a drunken state in public would be disturbing the peace while intoxicated.

xvi. Thou Shall Not Resist Arrest. Resisting Arrest is the act of avoidance of arrest. Running from an arresting Constable will get you in further trouble, or in trouble even if you are not found guilty of the crime for which you were hunted.

Forced Magics and Alchemies is the act of knowingly forcing alchemy or spells upon a citizen of the Haven without the explicit permission of the citizen. This is only allowed in cases such as healing or similar cases where the citizen may not be able to grant permissions.

xxxii. Thou Shall Not Perjure. Perjury is the act of lying to the Town Magistrate when appearing before the Court.

xxxiii. Thou Shall Not be Insolent. Insolence is the act of intentionally lying or deceiving the Thane or Town Council in an official setting. Insolence is also the act of intentionally misleading the Constable or a Town Guardsman so that they fail in apprehending a criminal.

xxxiv. Thou Shall Not Harbor. Harboring is the act of intentionally hiding or protecting a wanted criminal.

xxxvii. Thou Shall Not Accept a Bribe. Acceptance of Bribery is the act of a Constable accepting payment to not hunt a criminal or turn that criminal in. Acceptance of Bribery can also be the act of a Magistrate accepting payment to not convict a criminal, convict an innocent, or to make an extreme alteration in judgment.

xxxviii. Thou Shall Not Show Favoritism in Matters of Law. Favoritism is the act of a Constable’s refusal to turn a criminal in or make any attempt to hunt a criminal down due to friendship/comradery. Favoritism can also be the act of a Magistrate not convicting a friend or ally who is obviously guilty, or convicting an enemy who is obviously innocent.
